Plaintiffs Pichino Casey and Mitisha York's motion to deem admitted Requests For Admissions, Set One ("RFAs") served on Defendant Greentree Property Management, Inc. is GRANTED. The record demonstrates Defendant did not provide any responses to the RFAs. No meet and confer requirement exists for motions to compel responses for requests for production of documents when no responses have been provided. (See Code of Civil Procedure section 2033.280.) Plaintiffs, however, met and conferred. Defendant's failure to timely respond is not excused. Plaintiffs' RFAs, executed May 27, 2025, are deemed admitted.
Defendant Greentree Property Management, Inc. has not demonstrated she acted with substantial justification in connection with this discovery. Defendant Greentree Property Management, Inc. shall pay $550.00 to Plaintiffs Pichino Casey and Mitisha York as sanctions, payment no later than November 26, 2025. (See Code of Civil Procedure sections 2023.030, 2033.280(c).)

Any party who contests a tentative ruling must send an email to contestdept302tr@sftc.org with a copy to all other parties by 4pm stating, without argument, the portion(s) of the tentative ruling that the party contests. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
