Plaintiff Wells Fargo Bank, N.A.'s Motion For An Order Deeming The Truth Of The Matters Specified In Plaintiffs Request For Admissions As Admitted is GRANTED. Under Code of Civil Procedure section 2033.280(c), upon motion the court shall deem unanswered requests for admissions (RFAs) admitted, unless it finds the responding party, before hearing on the motion, served a proposed response to the requests for admission that is in substantial compliance with Code of Civil Procedure section 2033.220.
The record here demonstrates Plaintiff Wells Fargo Bank, N.A. sent requests for admissions that appear reasonably calculated to lead to the discovery of admissible evidence. (See Code of Civil Procedure section 2017.010.) Defendant Vernell W Lawson ultimately failed to answer/respond. The record does not demonstrate his failure was reasonable or justified. The requests set out in Plaintiff's Request for Admissions, Set One, executed June 18, 2025, are deemed admitted and the genuineness of the relevant documents is established.

The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.

Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
