The motion is defective in several ways. First, the parties did not provide courtesy copies of their papers. (See LRSF, rule 2.7(B).) Second, the notice of motion itself cites no authority and no grounds for issuance of the order. (See California Rules of Court, rule 3.1110(a) ["A notice of motion must state in the opening paragraph the nature of the order being sought and the grounds for issuance of the order."].) Third, the memorandum does not identify the applicable legal standard and explain why it is met on this record. (See California Rules of Court, rule 3.1113(b) ["The memorandum [in support of a motion] must contain a statement of facts, a concise statement of the law, evidence and arguments relied on, and a discussion of the statutes, cases, and textbooks cited in support of the position advanced."].)
Fourth, where parties move the court to execute a proposed judgment, the proposed judgment needs to be an exhibit in the motion and the merits of the request need to be explained; the key points of the judgment need to be summarized and discussed; where the proposed judgment includes an injunction, the parties need to explain why the court should enter and endorse such relief.
Such may be obvious to the parties, but it needs to be explained to the court, which has no particular familiarity with this action. The parties may file a new noticed motion correcting these deficiencies.
On the Law & Motion/Discovery calendar for Wednesday, October 1, 2025, Line 8, Plaintiff is ordered to prepare a proposed order which repeats the above text verbatim and email it to contestdept302tr@sftc.org prior to the time set for hearing.
