Defendant Michael Lehmann's unopposed Motion For Entry Of Judgment Under Code of Civil Procedure Section 438 is GRANTED. Under California Code of Civil Procedure Section 438, if a plaintiff fails to file an amended after a motion for judgment on the pleadings is granted as to the entire complaint with leave to amend, then the defendant who brought the successful motion for judgment may file a noticed motion seeking judgment in their favor. (See Code of Civil Procedure Section 438, subdivisions (h)(4)(C), (i)(1)(B) & (i)(2).)
Here, the court granted Defendant's motion for judgment on the pleadings as to all causes of action against him and the time to amend has run without Plaintiff Nathan Daniel Lehmann filing an amended complaint. Thus, the court orders that judgment shall be entered in this action in favor of Defendant Michael Lehmann and against Plaintiff Nathan Daniel Lehmann and that Plaintiff shall take nothing from Defendant Michael Lehmann by this action.

Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
