The Compliance Hearing Re: Final Distribution scheduled for 08/31/2026 is continued to 03/22/2027 at 02:30 PM in Department 21 at Rene C. Davidson Courthouse.

The compliance hearing on final distribution is CONTINUED.

On 10/10/24, the Court entered judgment consistent with approval of a class settlement. The judgment was against the corporate defendant and individual defendants Rod Weckworth and Helena Weckworth. The Corporate defendant paid $20,500 of the $300,000 settlement.

The order of 12/24/25 granted the motion of counsel for defendant with withdraw as counsel for the corporate defendant.

The amended judgment entered 8/18/26 states: “The Administrator shall distribute the $20,500 currently in the Qualified Settlement Fund Individual Settlement Payment checks shall be valid and negotiable for a period of not less than one hundred and eighty (180) calendar days from the date of issuance, and thereafter, the checks shall be cancelled.”

The Court ORDERS that counsel for plaintiff file a final accounting for all settlement funds at least five court days before the hearing date.

The Court ORDERS that funds not be distributed to the cy pres beneficiary until after Court approval of a final accounting.

The Court ORDERS that any fee award not be distributed to counsel until Court approval of a final accounting.
