Plaintiff Bank of America, N.A.'s unopposed Motion To Vacate Dismissal And Enter Judgment Under Terms Of Stipulated Settlement is GRANTED IN SUBSTANTIAL PART. Good cause appearing and pursuant to Code of Civil Procedure section 664.6, the court orders the dismissal be vacated and judgment be entered.
The court will include costs in the judgment, but less than requested. The payments under the agreement included costs to date and the parties provided that any judgment entered upon default on payment could include "motion and/or order fees required by the court." Such fees are not $530, but $60. Service was accomplished in-house by mail, so the court will not award $67 for service of process. The court will enter judgment for $563, including $503 in principal sum and $60 in costs. To the extent Plaintiff seeks different of additional relief, the motion is denied.
