County of Los Angeles - Central District Department 513 Martin Ruben Ramirez; Plaintiff, vs. California Landmark Group, INc, et al., Defendants. | Case No.: |
| | | Hearing Date: | August 31, 2026 | | | Time: | 10:00 a.m. | | | [Tentative] Order RE: Motion to Strike Pleadings and Vacate May 27, 2025 Order | MOVING PARTY: Plaintiff Martin Ramirez RESPONDING PARTY: Defendants California Landmark Group, Inc., R3 Lofts, LLC, and CLG Management, LLC Motion to Strike Pleadings and Vacate May 27, 2025 Order The court considered the moving and opposition papers filed in connection with this motion.
DISCUSSION Plaintiff Martin Ramirez ("Plaintiff") moves the court for an order striking pleadings filed on behalf of defendants California Landmark Group, R3 Lofts, LLC, and CLG Management, LLC ("Defendants") and vacating the court's May 27, 2025 order setting aside the Defendants' default. The court denies Plaintiff's motion for the following reasons. First, the court entered judgment in favor of Defendants and against Plaintiff in this action on April 13, 2026. The court therefore does not have jurisdiction to grant the relief requested by Plaintiff's motion.
Second, even if the court were to have jurisdiction, Plaintiff's motion is a motion for reconsideration of an issue already decided by the court, but Plaintiff has not shown by affidavit new or different facts, circumstances, or law that would support the relief requested. (Code Civ. Proc., Sec. 1008; May 27, 2025 Minute Order; December 16, 2025 Minute Order.) ORDER The court denies plaintiff Martin Ramirez's motion to strike pleadings and vacate May 27, 2025 order. The court orders defendants California Landmark Group, Inc., R3 Lofts, LLC, and CLG Management, LLC to give notice of this ruling.
IT IS SO ORDERED. DATED: August 31, 2026 _____________________________ Robert B. Broadbelt III Judge of the Superior Court
