Plaintiffs are the successors in interest to Banko Brown, who was shot by a security guard contractor at Walgreens after an altercation that allegedly arose from the guard's observation of Brown's shoplifting. Plaintiffs seek to lift the protective order in this case prohibiting the deposition of James Kehoe, formerly the CFO of Walgreens Boots Alliance, Inc., under the apex doctrine.
For the reasons stated herein, the court denies the request in part, continues the matter for hearing to October 30, 2025, and orders the parties to meet and confer about a stipulation concerning Kehoe's statements on the earnings call.
