The motion for reconsideration is denied. Even assuming ChromaDiverse Inc.'s motion satisfies the jurisdictional prerequisites for seeking reconsideration, the court does not see a basis to revisit its prior order.
ChromaDiverse presents argument that ownership of the physical Marbeth Collection photographs (as distinct from the right to license or distribute those photographs) is not governed by the Copyright Act. The court does not disagree, but this was not the basis for the court's order with respect to claims concerning the physical photographs. It concluded in its Order re Motion to Quash that it lacks specific personal jurisdiction over Dance Theatre of Harlem to hear claims concerning the ownership of the physical Marbeth Collection photographs, because there is insufficient connection between that controversy and the forum state to satisfy the minimum-contacts test.
ChromaDiverse's reconsideration motion does not offer new facts or authorities concerning this conclusion. Its reconsideration motion asks for leave to amend, but it does not present new arguments concerning the existence of personal jurisdiction in California over Dance Theatre concerning a dispute about the ownership of physical property maintained in New York.
