Plaintiffs Jeffrey Smith, et al. move for reconsideration of this court's order denying Smith's motion to compel defendant Hanson Bridgett LLP to produce documents and to compel Fred Weil to answer questions in response to Smith's deposition notice. Smith seeks reconsideration based on (1) the court's error in describing attorney Fred Weil's letter of August 24, 2012 in its order; (2) deposition testimony of Smith's counsel Mark James concerning his belief that Weil represented Smith; and (3) Smith's counsel's inability to respond fully to the questions the court provided to counsel in its tentative.
The court grants reconsideration because it in fact misdescribed the letter in its prior order. However, nothing in the prior order turned on that error, and the court reaches the same conclusion upon further consideration. The court therefore grants reconsideration sua sponte, vacates the August 20, 2025 order, and replaces it with this order denying the motion to compel based on similar reasoning. The motion to compel is denied.

The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
