The court asks the parties to be prepared to address the following issues: 1. For the majority of class members to whom notices were initially mailed to the wrong addresses, why were they provided with a 30-day opt out window instead of the 45-day window in the court's preliminary approval order? Why do the parties believe that a 30-day opt-out window was sufficient?
2. Were opt-out rates lower for the pool of class members who received a 30-day opt out window instead of a 45-day opt-out window?
3. Re the Verita error in calculating estimated payment amount: It appears from the description that Verita's error omitted a payment and therefore did not overstate any payment amount in the notices (i.e. no class member was informed the payment would be higher than the actual payment). Is this correct?
4. Please email to the clerk a proposed final approval order prior to the hearing at calendar301@sftc.org. Please be sure the final approval order includes a compliance hearing date for the settlement administrator to provide a declaration confirming that all funds were disbursed.

The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion or Discovery Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
