Defendant Surface Pumps, Inc ("Defendant" or "Surface Pumps") Motion for Summary Judgment is DENIED. Opposition filed. Reply filed.
Plaintiffs' objection to the Declaration of Steve Durrett ("Mr. Durrett"), in its totality is SUSTAINED on the grounds of lack of personal knowledge. (Code Civ. Proc. 437c, subd. (d); LAOSD Asbestos Cases [Ramirez] (2023) 87 Cal.App.5th 939, 947-951 [corporate representative lacked personal knowledge to testify regarding events predating her employment by defendant and could not testify to hearsay].)
Defendant's objection to the Declaration of Ron Kyner, 3-4 (1) ["I recall it was typical for James Brown to wear his dust-covered work clothes home from work at Shell Oil Company between 1969 and 1985."] is OVERRULED.
Defendant's objections to Exhibit D [May 16, 2002, Deposition of Barry Bradshaw, Gould Pumps Corporate Representative and General Counsel] and Exhibit F [January 8, 2008, Deposition of Bruce Corner, the Person Most Knowledgeable and Custodian of Records for Gould Pumps] is OVERRULED as it does not lack foundation and is admissible on this motion. The testimonies of Mr. Bradshaw and Mr. Corner do have foundation as the Corporate Representative and Person Most Knowledgeable for Gould Pumps.
