DEFENDANT ALVIN WILLIAMS MOTION TO STRIKE COMPLAINT is GRANTED WITHOUT LEAVE TO AMEND. Paragraphs 15 and 19d are stricken from the Complaint as improper. Even broadly construing the allegations on the face of the Complaint, the only reasonable inference that may be drawn is that there is no written agreement between the parties to this action, much less one that specifically provides for attorney fees. Plaintiff cites no legal authority for the proposition that it may hypothetically be entitled to attorney fees based upon a written agreement to which Plaintiff is not a party, which may or may not exist. =(501/CFH)
