DEFENDANT SYLVESTER HARRIS MOTION FOR JUDGMENT ON THE PLEADINGS; is DENIED. The notice of motion identifies CCP 430.10(b) as the statutory basis for this motion. CCP 430.10 does not apply to a motion for judgment on the pleadings. CCP 438 provides the limited permissible grounds for a motion for judgment on the pleadings.
