Ruling

VELASQUEZ is ORDERED to provide verified responses and documents, without objection by no later than 30 days from date of the Court's issuance of this Order. Defendant's Requests for Admissions, Set One is Deemed Admitted. This date may be extended by stipulation of the parties. If any objections are asserted, it will be tantamount to no response at all and will be deemed a violation of this Court's order. Reasonable sanctions are GRANTED in the total amount of $300.00. Plaintiff CESAR VELAQUEZ is ORDERED to pay Moving Party and their counsel of record sanctions in the total amount of $300.00, payable within 60 days from the date of the Court's issuance of this Order.

Background

On May 14, 2025, Plaintiff HUGO MORENO ("Plaintiff") filed a Complaint against Defendants ROBERT PABLOS ("Pablos"), PABLOS AUTO SALES ("PAS"), L.A.W. RECOVERY, and PRIMERA FINANCIAL CORP. ("Primera"). The Complaint sets forth four causes of action for: (1) Breach of Contract [Against Defendant Pablos and PAS]; (2) Fraud and Misrepresentation [Against Defendants Pablos, PAS, and Primera]; (3) Conversion [Against Defendants Pablos, PAS, and Primera]; and (4) Violation of Truth in Lending Act [Against Defendants PAS and Primera].

On September 19, 2025, Cross-Complainants PABLO A PABLOS and PRIMERA FINANCIAL CORP, dba PABLOS AUTO SALES ("Cross-Complainants) filed a Cross-Complaint against Cross-Defendant HUGO MORENO ("Cross-Defendant"). On August 14, 2026, Cross-Defendant filed the instant Anti-SLAPP motion. Procedural Issues A special motion to strike "may be filed within 60 days of the service of the complaint or, in the court's discretion, at any later time upon terms it deems proper." (CCP Sec. 425.16(f).) Cross-Defendant filed the instant Anti-SLAPP motion only thirteen (13) days before the instant hearing.
