The Court will call this matter and hear from counsel on all issues. The Court also has three questions.
1. Plaintiff submitted new evidence raising new issues with her reply. Defendant objects. Should the Court sustain the objection and ignore the new evidence and issues? If not, does Defendant request the opportunity to submit a supplemental filing in response to the reply?
2. Defendant makes an affirmative request for relief (disqualification) in his opposition. Although the Court understands the background here (based on the input from counsel received when the ex parte application was heard), this is not procedurally proper in a civil case. (The Court understands that the procedure in the Family Law Division may be different.) Does Plaintiff waive the procedural irregularity and agree that if her motion is denied, the Court may then proceed to consider the affirmative request made by Defendant?
3. Do the parties agree that the case law is not settled with regard to whether, in this context, an ethical wall is appropriate and sufficient? Case Number: 25STCV35992 Hearing Date: August 27, 2026 Dept: 514 Tentative Ruling The demurrer to the Complaint and motion to strike are therefore placed off calendar as moot. On April 22, 2026, Defendant Union Rescue Mission ("Defendant") filed a demurrer to the Complaint and a motion to strike; the hearing was initially set for June 16. On May 20, 2026 (pursuant to a stipulation of the parties, and before the last day to file an opposition to the demurrer and motion to strike), Plaintiff Jiezhong Li ("Plaintiff") filed a First Amended Complaint (the "FAC").
It is not clear from the Court file whether Plaintiff ever served Defendant with the FAC. If not, Plaintiff is ordered to serve Defendant with the FAC forthwith. All documents that are filed in the Court must be served on all parties. If Defendant has been served with the FAC, Defendant must file an answer or other responsive pleading by the statutory deadline. Defendant is ordered to give notice.
