While not clear, it appears that Defendant either requests that (1) this Court determine the subject matter jurisdiction of the federal courts or that (2) this Court determine that this Court does not have subject matter jurisdiction.

As to the first issue, this Court does not determine the parameters of the federal court's subject matter jurisdiction. See Plowshares v. Kemp (2005) 423 F.Supp.2d 1031. Such determinations are made by federal courts.

As to the second issue, moving party cites no authority for the proposition that this Court lacks subject matter jurisdiction. =(501/CFH)
