Swish Analytics Inc.'s motion to compel further responses to special interrogatories is denied as to interrogatory 7 and granted as to 8. No sanctions are awarded. Swish's meet and confer efforts were sufficient.

With respect to 7, defendants Oddsjam Inc. and Opticodds Inc.'s (collectively Oddsjam) responses are sufficiently complete and responsive. Swish requested information about preservation of log data and the existence of log data as of December 20, 2024. Oddsjam responded that its software does not create logs. It further explained that it does not consider odds data to be logs, but described what it has done to preserve odds data since that date. Oddsjam's reading of the interrogatory is reasonable.

With respect to 8, in response to a request for monthly revenues, Oddsjam produced incomplete documentation and relied on Code of Civil Procedure, section 2030.230. Swish shows that the referenced documents do not fully and completely respond to the interrogatory and that Oddsjam has the ability to answer the interrogatory at least partially and more fully as to revenue, including revenue from enterprise clients. (Kowalski Decl., Exs. 22-24.) In addition, Oddsjam does not respond to the portion of the interrogatory concerning attribution of revenue to other entities. Oddsjam shall amend by September 8, 2026. No sanctions are awarded; both parties' discovery position had substantial justification.

Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.

The court no longer provides a court reporter in the Law & Motion or Discovery Department. Parties may retain their own reporter, who may appear in the courtroom or remotely.
