Tentative Ruling
Defendant NRT West, Inc. dba Coldwell Banker Realtys, erroneously sued as Leos Employer: Coldwell Banker Realty, (Coldwell) motion for judgment on the pleadings to self-represented Plaintiff Soraya Rigors (Plaintiff) fifth amended complaint (5AC) is CONTINUED on the Courts own motion to August 27, 2026 in this department. Coldwell filed this motion on December 5, 2025. Thereafter, between December 2025 and May 2026, Plaintiff made multiple different filings that appear to relate to this motion.
Notwithstanding these filings, Coldwell, on July 15, 2026, filed a Notice of No Opposition Filed Against its Motion for Judgment on the Pleadings (Notice of No Opposition) in which Coldwell represents as of the date of filing, there is no opposition identified or posted on the Courts website and further that Coldwell, as of the date of this filing has not received an opposition via email or mail. (Notice of No Opposition at 2:3-5, 2:6-7; see also Declaration of B. Gardiner McKleroy ¶¶ 3, 4.)
Given Coldwells representation that it was not properly served with any opposition to this motion, the Court CONTINUES the hearing date on this motion. In doing so, the Court orders Plaintiff to serve her opposition on Coldwell no later than July 30, 2026. Plaintiff must also file a proof of service demonstrating service of the opposition no later than August 6, 2026. Plaintiff should be aware that the Court will only consider the opposition papers which have been served on Coldwell. Coldwell is permitted to file a reply responding to the opposition papers served by Plaintiff.
The reply must be filed and served no later than August 20, 2026. Other than the filings as allowed above, no further briefing is permitted without leave of Court. The minute order is effective immediately. No formal order pursuant to California Rules of Court, Rule 3.1312, or further notice is required.
On the Court's own motion, the Hearing on Motion for Judgment on the Pleadings scheduled for 07/23/2026 is continued to 08/27/2026 at 09:00 AM in Department 16C at Tani G. Cantil- Sakauye Courthouse.

Parties requesting services of a court reporter will need to arrange for private court reporter services at their own expense, pursuant to Government code §68086 and California Rules of Court, Rule 2.956. A Stipulation and Appointment of Official Reporter Pro Tempore (CV/E-206) is required to be signed by each party, the private court reporter, and the Judge prior to the hearing, if not using a reporter from the Courts Approved Official Reporter Pro Tempore list.
Once the form is signed it must be filed with the clerk. If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away. Once approved, the clerk will forward the form to the Court Reporters Office and an official reporter will be provided.
