Petitioner Corporate Waste Solutions, Inc.'s unopposed Petition to Compel Arbitration is DENIED WITHOUT PREJUDICE. The court may order parties to arbitrate a dispute where the record demonstrates, among other things, a party to the arbitration agreement refuses to arbitrate. (Code of Civil Procedure section 1281.2.)
Here, Petitioner presents two February 2023 letters to individuals identified as "Interstate Hotel and Resorts - Aimbridge Hospitality" representatives and a June 2024 letter to an attorney at Holland & Knight, all from Petitioner's counsel and demanding arbitration; Petitioner alleges it received no response. Non-responses to the letters is not a refusal. Nor does the record identify the nature of the dispute or the relief sought, and the court is not willing to order a party to arbitrate unidentified claims for unidentified relief. The court has no way of determining whether the dispute is covered by the arbitration agreement.
In a case such as this one, the petitioner would need to file an arbitration demand with AAA, which includes a description of the dispute, the relief sought, and a copy of the arbitration agreement; if then Respondent refuses to participate, Petitioner may then pursue an order compelling participation. Nor does this record support an order appointing an arbitrator. (See Code of Civil Procedure section 1281.6.) Petitioner has not explained the AAA appointment process, let alone why that process cannot be followed.

Any party who contests a tentative ruling must send an email to contestdept302tr@sftc.org with a copy to all other parties by 4pm stating, without argument, the portion(s) of the tentative ruling that the party contests. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.

Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
