1 - Plaintiff Chubb Indemnity Insurance Company's Motion to Compel Defendant Sunshine Transport's Responses to Form Interrogatories, Set One and Request for Sanctions is GRANTED. The discovery requests at issue appear reasonably calculated to lead to the discovery of admissible evidence. (See Code of Civil Procedure section 2017.010.)
Defendant has not established that it has provided any responses to the Interrogatories. Defendant's failure to timely respond is not excused. Defendant's contention in its late-filed opposition-filed only three court days before the hearing (and then after hours)-that it intends to serve substantially compliant responses before the hearing does not, in fact, moot the motion. Further Defendant did not make the showing required under section 2030.290(a); in any event, the court declines to exercise its discretion in favor of relief under section 2030.290(a).
No meet and confer requirement exists for motions to compel responses for Interrogatories when no responses have been provided. (Code of Civil Procedure section 2030.290.) Plaintiff, however, met and conferred. Defendant shall serve verified, objection-free, substantive responses to Plaintiff's Form Interrogatories, Set One by December 24, 2025.
The court does not find Defendant Sunshine Transport acted with substantial justification in connection with this discovery. Defendant Sunshine Transport shall pay to Plaintiff Chubb Indemnity Insurance Company, through counsel, $450 as sanctions, payable payment no later than by December 24, 2025. (See Code of Civil Procedure sections 2023.010, 2023.030, 2030.290(c).)

The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
