This is an action for breach of lease. Plaintiff 14333 Inglewood LLC ("Plaintiff") alleged that it entered into a lease agreement with defendant Mobile World Logistics LLC, guaranteed by defendant Hasib Mobh. Plaintiff alleged that defendants Mobile World Logistics LLC and Hasib Mobh (collectively, "Defendants"), as alter egos of one another, failed to pay rent under the lease agreement.
After an uncontested non-jury trial, judgment was entered in favor of Plaintiff and against Mobile World Logistics LLC. Contrary to Plaintiff's contention, judgement was not entered against Mobh.
Plaintiff moves for attorney's fees and costs against Mobh and Mobile World Logistics LLC, as the prevailing party in this action and pursuant to the lease agreement. Plaintiff provides the declaration of attorney Gregory W. Koonce, who declares his hourly rate in this action. No defendant opposed the motion.
A motion must be served and filed at least 16 court days before the hearing. (Code Civ. Proc. Sec. 1005, subd. (b).) Here, a proof of service was filed indicating service upon Defendant Mobh on July 24, 2026. However, judgment was not entered against Mobh. In addition, no proof of service was filed indicating service upon Defendant Mobile World Logistics LLC, the only defendant against whom judgment was entered. Additionally, there is no proof of service as to Plaintiff's memorandum of costs.
