While the court may, if necessary, postpone trial upon granting leave to amend (W&W El Camino Real, LLC, supra, 226 CA 4th at 270), such relief is not necessary at this juncture. Defendant has not met its burden of establishing substantial prejudice as a result of the proposed amendment. Based on the evidence submitted, the court finds that Defendant failed to establish grounds which warrant denial of Plaintiff's motion for leave to file the proposed Second Amended Complaint. Accordingly, the motion is granted. Defendant shall have 20 days to file a responsive pleading.
Plaintiffs have not established that Defendant acted in bad faith in opposing the motion for leave to amend, or that other conditions exist which make the imposition of sanctions just or appropriate under the circumstances. Accordingly, their request for imposition of $4125 in sanctions against Defendant is denied.

Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely.
