Code of Civil Procedure 2024.050(a) requires a party to meet and confer with his or her opponents prior to filing a motion to re-open discovery. Here, Defendants Smith, Young, Kampouris, Keating and Mimura contend that Plaintiff's efforts to meet and confer were inadequate. Plaintiff responds that when he raised the issue of re-opening discovery during email exchanges regarding continuing the trial date in August and September 2025, Defendants were adamantly opposed. Some evidence supports Plaintiff's assumption that further efforts to meet and confer prior to filing the motion might be futile.
The court nevertheless believes that requiring the parties to participate in a good faith effort to resolve this issue would promote judicial economy and possibly give raise to a negotiated resolution, Accordingly, the court directs the parties to meet and confer via telephone and/or email on the issue of whether discovery, including expert witness disclosure, should be re-opened prior to the May 11, 2026 trial date. Plaintiff's motion shall be continued for hearing to December 30, 2025 at 9:00 a.m. Each side shall file and serve a declaration documenting the results of the court-ordered meet and confer on or before December 23, 2025.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 302 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. Any party who contests a tentative ruling must send an email to contestdept302tr@sftc.org with a copy to all other parties by 4pm stating, without argument, the portion(s) of the tentative ruling that the party contests. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing. Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
