Plaintiffs' Motion For Preliminary Approval Of Class Settlement is CONTINUNED TO MARCH 4, 2026, AT 9 AM IN THIS DEPARTMENT AND THE COURT ORDERS FURTHER BRIEFING AND EVIDENCE.
Plaintiffs and any interested party are ordered to provide further information and briefing on the following issues: (1) the court needs a linguistic profile of the class and a notice plan that accommodates all significant linguistic communities represented in the class; briefing regarding the definition of significant linguistic community is required; (2) the proposed notice should include electronic notice options; the court needs briefing on appropriate electronic notice options, their feasibility and a proposed plan regarding same; (3) Plaintiffs must brief the specifics of the notice plan and why the plan is sufficient to assure notice to all class members; (4) the PAGA settlement is part of the class settlement and must be analyzed in the memorandum of points and authorities; reference to a declaration is not sufficient; (5) Plaintiffs must prove and note in their supplemental brief that LWDA has been served with appropriate notice of the proposed settlement; (6) Plaintiffs must brief the scope of the proposed release; the court's initial impression is the scope of the release may be overly broad; (7) Plaintiff must brief what is to happen to unclaimed funds and justify such disposition; and, (8) Plaintiffs must provide further information and analysis supporting the proposed service awards for the class representatives; the court's initial impression is the service awards in the amount suggested are not supported.
The motion is continued to March 4, 2026, at 9 a.m.in this Department. Plaintiff shall file and serve a supplement brief/memorandum (and any supporting evidence) identifying and discussing the above issues no later than February 17, 2026, with courtesy copies delivered to the department within 24 hours of submission for filing.
