Here, after December 17, 2024, there was no confusion on Petitioner's part as to whether Respondents were public employees or not. Upon learning this information, Petitioner took nine months to take any new action before submitting her government claim on September 11, 2025.
Petitioner's arguments for equitable estoppel are rejected; she had more than enough notice after the initial answer of the applicable statute. Respondent's answer included the applicable Government Code sections 911.4, 945.4, and 946.6. (Def. RJN, Ex. C, p. 2.)
Petitioner's arguments delaying accrual into 2025 are similarly rejected. Petitioner was denied Nitrofurantoin and other medications used to treat urinary tract infections despite experiencing symptoms and positive tests on November 10, 2023, and February 12, 15, and 21, 2024. (La Decl. 5, 7.) The most recent instance when Petitioner was denied medication was on September 11, 2025, while she was experiencing a mild fever. (La Decl. 10.) She does not state that the fever was related to her urinary tract infection symptoms. Thus, the only claim of the manifestation of "appreciable harm" Petitioner offers is in November of 2023 and February of 2024. Petitioner does not sufficiently support her delaying of accrual argument to include the incident in September of 2025.
Thus, Petitioner's deadline to file a timely claim was, at the latest, August 21, 2024, six months after the accrual of her claim. She had until February 21, 2025, to apply for leave to file a late claim, and did not do so until September 19, 2025. Petitioner's delay does not appear to be reasonable, and her request for relief under 946.6 is denied.

Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion or Discovery Department. Parties may retain their own reporter, who may appear in the courtroom or remotely.
