The unopposed motion in support of discovery request for late filing and to amend complaint is ordered off calendar. Petitioner's late-filed proof of service states that the motion was provided to the State's counsel on December 5, 2025. All moving papers must be served on the opposing party at least 16 court days before the hearing, with additional time depending on the manner of service, and a proof of service must be filed with the court not later than five court days before the hearing. (See Code of Civil Procedure, section 1005, subdivision (b) ["all moving and supporting papers shall be served and filed at least 16 court days before the hearing"]; California Rules of Court, Rule 3.1300, subdivision (c) ["Proof of service of the moving papers must be filed no later than five court days before the time appointed for the hearing."].)
The court notes that part of the relief petitioner seeks here is the opportunity to amend; petitioner was granted leave to amend his complaint in the court's recent demurrer order.
