CROSS DEFENDANT CITY AND COUNTY OF SAN FRANCISCO'S MOTION FOR JUDGMENT ON THE PLEADINGS. The unopposed motion for judgment on the pleadings is sustained with leave to amend. The City accurately notes that cross-complainant Mission Housing Development Corporation has not pled its compliance with the claims presentation requirement of section 945.4 of the Government Code. In addition, negligence is not a cause of action that lies against the City; a public entity is immune from liability except as provided by statute. (Gov. Code, section 815.) The court grants leave to amend; it cannot assume as a matter of fact that cross-complainant cannot show compliance.

For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 301 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.

The court no longer provides a court reporter in the Law & Motion or Discovery Department. Parties may retain their own reporter, who may appear in the courtroom or remotely.
