Ruling

CASE NUMBER: 22CV-0200669 Tentative Ruling on Motion to Substitute Successor in Interest: Plaintiff U.S. Bank Trust, N.A., as Trustee for LSF9 Master Participation Trust, moves to substitute Charles Sells in place of defendant Joe Tiegue Sells pursuant to Code of Civil Procedure sections 368.5 and 389. This matter first came on for hearing on July 6, 2026. The Court’s tentative stated that because Charles Sells had not yet appeared in the action, the Court would require proof of service of the Motion in the manner of summons. The moving party did not appear at the hearing. The clerk mailed a copy of the minutes as a courtesy. No proof of service of the Motion in the manner of summons has been filed. Therefore, the Motion is DENIED without prejudice.
