Tentative Ruling

NOTICE:

Consistent with Local Rule 1.06(B), any party requesting oral argument on any matter on this calendar must comply with the following procedure:

To request limited oral argument, on any matter on this calendar, you must call the Department 8C Oral Argument Request Line at (916) 874-8380 by 4:00 p.m. the Court day before the hearing and advise opposing counsel. Once the form is signed it must be filed with the clerk. If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away. Once approved, the clerk will forward the form to the Court Reporter’s Office and an official reporter will be provided.

Defendant Lippert Components, Inc.’s (“Lippert”) application for an order admitting Sophia Vander Kooy as counsel pro hac vice is CONTINUED to August 24, 2026 at 1:30 p.m. in Department 8C.

Rule 9.40(c)(1) of the California Rules of Court provides:

A person desiring to appear as counsel pro hac vice in a superior court must file with the court a verified application together with proof of service by mail in accordance with Code of Civil Procedure section 1013a of a copy of the application and of the notice of hearing of the application on all parties who have appeared in the cause and on the State Bar of California at its San Francisco office. The notice of hearing must be given at the time prescribed in Code of Civil Procedure section 1005 unless the court has prescribed a shorter period.

Lippert’s proof of service states that the application was served on Plaintiffs Jeffrey Wansor and Georgette Wansor (collectively, “Plaintiffs”) via electronic service. The proof of service also states that the application was uploaded to the State Bar’s website through its online application portal. The proof of service does not show that service was made in any manner on Defendants Alliance RV, LLC (“Alliance”) and RV Retailer Folsom Lake, LLC dba Blue Compass RV

(“Blue Compass”), who appeared in this action on June 11, 2025 when they filed their Answer to Plaintiffs’ Complaint. Rule 9.40(c)(1) requires the application be filed with a proof of service by mail showing service on all parties who have appeared and the State Bar. The implication from this rule is that a pro hac vice application must be served by mail, not only on the State Bar but also on all other parties who have appeared, and that electronic service alone is insufficient. Thus, Lippert’s proof of service fails to comply with Rule 9.40(c)(1) and does not establish effective service of the application.

Lippert is directed to serve, by mail, the application papers, along with an amended notice of the continued hearing date, on Plaintiffs, Alliance, Blue Compass, and the State Bar at its San Francisco office, and to file proof of service that complies with Code of Civil Procedure section 1013(a), by no later than July 23, 2026. The amended notice shall include information regarding the Court’s tentative ruling system as required by Local Rule 1.06(D).

On the Court's own motion, the Hearing on Motion to be Admitted Pro Hac Vice as to Sophia Vander Kooy scheduled for 07/20/2026 is continued to 08/24/2026 at 01:30 PM in Department 8C at Tani G. Cantil-Sakauye Courthouse.
