TENTATIVE RULING:
Defendant A3 Mobility LLCs (Defendant) motion to compel Plaintiff Yvette Reynolds (Plaintiff) further responses to Defendants form interrogatories, set one, is UNOPPOSED and GRANTED.
Defendant propounded its form interrogatories on June 16, 2025. (Declaration of Alexander Cheung (Cheung Decl.), ¶ 3, 2025.) Plaintiffs counsel requested and was granted seven extensions to respond. (Id., ¶¶ 4-9.) On October 24, 2025, Plaintiff served objection only responses signed by her attorney. (Id., ¶ 10; Ex. J.) On November 5, 2025, Defendants counsel sent a meet and confer letter to Plaintiffs counsel requesting amended responses. (Id., ¶ 11.) On November 19, 2025, counsel for both parties engaged in a telephonic meet and confer regarding the responses, but Plaintiffs counsel was unable to meet and confer because he was unable to reach Plaintiff. (Id., ¶ 12.)
Plaintiff did not file an opposition to this motion. A partys failure to oppose a motion is construed as a concession on the merits of the motion. (See D.I. Chadbourne, Inc. v. Superior Court (1964) 60 Cal.2d 723, 728, n.4.)
No later than June 1, 2026, Plaintiff shall serve verified responses, without objections, to Defendants form interrogatories, set one.
