ON THE COURT'S OWN MOTION DUE TO LACK OF JUDICIAL COVERAGE, THE COURT WILL HEAR THIS MATTER ON SEPTEMBER 4, 2026, AT 8:30 A.M. IN DEPARTMENT NINE. THERE WILL BE NO HEARING ON AUGUST 21, 2026. SHOULD A PARTY WISH TO REQUEST ORAL ARGUMENT, THE BELOW PROCEDURES REMAIN IN EFFECT.

On July 1, 2026, Defendant, Wendy D’Arcy (“Defendant”) filed a Motion to Set Aside Default on the grounds of mistake, inadvertence, surprise, and excusable neglect pursuant to Code of Civil Procedure § 473(b). Defendant asserts that due to financial hardship, difficulty locating counsel, and misunderstanding the filing deadline, she failed to timely file a response. It is unknown to Defendant whether a default has been entered. The Court is not in possession of a Request for Entry of Default filed by Plaintiff or Default Judgment.

Defendant’s motion is denied without prejudice.
