The Court granted the motion for summary judgment by Defendant Cummins, Inc. after Defendants filed this motion. As such, the motion by Defendant Cummins, Inc. is moot. Further, after Defendants filed this motion, in its order of July 14, 2026, the Court granted Defendants' ex parte application to continue trial. (July 14, 2026 Minute Order.) Accordingly, the Court places the motion off
