Paragraph 3.c of the petition appears to state that decedents address at death was 5270 E. Los Angeles Ave., Simi Valley, CA 93063. But the attached death certificates shows his address as 752 Talbert Ave., Simi Valley, CA 93065. Which is the correct address?
Paragraph 3.f(1) states decedent died intestate, but Paragraph 3.f(3) is also checked, stating that the original will has been lost. The caption of the petition does not indicate a lost will however, and Paragraph 3.f(2) is not checked and no will is asked to be admitted. Paragraph 3.g(1)(a) is checked (proposed executor is named as executor in the will and consents to act). Paragraph 3.g(2)(a) and (c) are also checked (appointment of administrator). The two allegations are inconsistent. Paragraph 4 is checked (will does not preclude administration of this estate under the IAEA). Did the decedent die intestate or testate? The Court notes that this estate is that of Efrain Moreno, not Christina Moreno.
Paragraph 5.a(5) is checked but it is uncertain under Paragraph 8 whether the decedent was survived by any children. Paragraph 5.a(3) or (4) and (7) or (8) are not completed. Paragraph 8 fails to state the relationships of the person listed to the decedent.
The Court intends to continue the hearing and direct Petitioner to serve and file a verified supplement addressing all of the foregoing issues.
Petitioner is to also serve and file the notice of petition to administer estate (form DE-121) and the proof of publication prior to the next hearing.
