To submit on the tentative decision, email courtroom44@ventura.courts.ca.gov before 8:00 a.m. on the hearing date, copying all other parties. Use the subject line “SUBMISSION ON TENTATIVE”, [Case Number], [Case Title] and [Party]. If not all parties submit, the hearing will proceed, and the tentative ruling may change.

The Court may adopt, modify or reject the tentative ruling after hearing. The tentative ruling has no legal effect unless and until adopted by the Court.

Motion: Plaintiff’s Motion for Final Approval of Class Action and PAGA Settlement

Tentative Ruling:

Plaintiff’s Motion for Final Approval of Class Action and PAGA Settlement is CONTINUED to October 28, 2026 at 1:30 p.m. in Department 44.

Plaintiff shall file, sufficiently in advance of the continued hearing:

1. A supplemental declaration from Apex, executed after expiration and processing of the August 28, 2026 extended response deadline, stating the final number of Class Members, Participating Class Members, exclusions, objections, disputes, Workweeks, and PAGA Pay Periods, together with updated settlement-payment calculations;

2. The mediation and expert/consultant invoices required by the Court’s preliminary approval ruling;

3. A corrected Class Counsel lodestar eliminating or explaining entries attributed to the Magallanes matter; and

4. A revised proposed Judgment and Order Granting Final Approval conforming to the final administration figures and the Court’s ruling and reconciling the identification of Class Counsel.
