Ruling

2026PRDE065712: IN THE MATTER OF ILSAVADA E WOLLMAN 08/20/2026 in Department J6 Hearing on Petition for Probate of Will and for Letters Testamentary

Notice of petition to administer estate was not given to the American Cancer Society. On 7/23/26, Petitioner filed a new DE-121 listing American Cancer Society. However, American Cancer Society is served “c/o Holland & Knight.” A notice mailed to a person in care of another person is insufficient unless the person entitled to notice is an adult and has directed the party giving notice in writing to send the notice in care of the second person. (Cal. Rules of Court, rule 7.52(a)(2).) Has American Cancer Society directed Petitioner to serve notice in care of Holland & Knight?

The same question applies to Paralyzed Veterans of America, which was served the new DE-121 (which serves as a notice of continuance for Paralyzed Veterans of America) also “c/o Holland & Knight.”

Subject to statutory notice, grant. Appoint Petitioner Helen Gretz as the executor of the estate, with limited IAEA powers. Admit to probate the will dated 9/28/22. Set bond of $330,000. (Prob. Code, § 8571.)
