Ruling

2025PRDE050539: IN THE MATTER OF ROGER MACURA 08/19/2026 in Department J6 Hearing on Petition for Waiver of Accounting and Final Distribution

The Court notes that the schedule for receipts is not done correctly. Receipts include property on hand at the beginning of the account period (e.g., the value of the CD account, the vehicle, etc.). There is no separate schedule for gains, if Petitioner intends to state that there were no gains. It appears that Petitioner is attempting to state that receipts consist only of the $308.40; that there were no gains; and that losses were $50,000. At the hearing, Petitioner is to confirm or deny the foregoing.

Subject to the foregoing, a final account is waived. Approve statutory fees of $8,031.77 to Petitioner’s counsel based on her representation that this Court previously agreed that the donation of the car was not a loss. Petitioner waives her fees. Hermance Law to reimburse the estate $899.10.

The proposed final distribution of the estate to Arleen Vines is consistent with the laws of intestate succession.
