Tentative Ruling

NOTICE:

Consistent with Local Rule 1.06(B), any party requesting oral argument on any matter on this calendar must comply with the following procedure:

hearing, if not using a reporter from the Court’s Approved Official Reporter Pro Tempore list.

Once the form is signed it must be filed with the clerk. If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away. Once approved, the clerk will forward the form to the Court Reporter’s Office and an official reporter will be provided.

TENTATIVE RULING:

The Petition for Approval for Transfer of Payment Rights by and between J.G. Wentworth Originations, LLC (“Petitioner”) and Cheryle Schlegel (“Payee”) pursuant to California Insurance Code section 10134, et seq., is ruled upon as follows.

Payee desires to transfer one payment of $130,000 due March 5, 2032, with a discounted present value of $99,927.95. If the transaction is approved, Payee would receive $75,000. The transaction would result in an effective interest rate of 9.86%.

This matter was originally set for hearing on July 22, 2026. The Court’s tentative ruling before that hearing found that Petitioner had not provided all the information required for the Court’s consideration and had not shown that the transfer of the structured settlement would be fair and reasonable and in the best interest of Payee, taking into account the welfare and support of his or her dependents. (Ins. Code, § 10137.) Payee submitted an amended declaration on July 27.

Payee is 59 years old and married with no minor children and is the guardian for her 9- year-old grandson, who resides with Payee and her spouse. (Schlegel Amend. Decl. ¶ 8.) Payee is unemployed, disabled and receiving Social Security. (Ibid.) Payee’s husband is employed by the State of California, with a monthly salary of $3,500, but is critically ill and nearing death. (Ibid.) Payee entered into the original structured settlement “on about 2019” as compensation for a medical malpractice claim. (Id. ¶ 4.) The settlement was not intended to provide for medical care and treatment or provide for necessary living expenses. (Id. ¶¶ 6–7.)

Payee declares that she is experiencing a financial hardship and, if approved, will use

the money to pay off existing debt, including $25,000 owed to Bank of America with an interest rate of 18.99%. (Schlegel Amed. Decl. ¶ 11.) The remainder of the funds will be used towards a down payment on a house in Georgia, where Payee plans to move after her husband passes. (Ibid.)

Payee completed a prior transaction related to the settlement, in which she transferred $150,000 due March 5, 2027, and $100,000 (out of $230,000) due March 5, 2032, in exchange for a total of $158,000. (Schlegel Amend. Decl. ¶ 9.) Payee used that money to pay for her husband’s truck and to pay down a home equity line of credit for home improvements. (Ibid.) The previous transaction was approved on March 23, 2022.

The Court finds on the facts presented to it that:

(1) The proposed sale of one payment of $130,000 due March 5, 2032, with a discounted present value of $99,927.95, in exchange for $75,000 is in the best interest of the Payee, taking into account the welfare and support of the Payee’s dependents.

(2) Payee has been advised in writing by the transferee to seek independent professional advice regarding the transfer and has knowingly waived, in writing, the opportunity to receive the advice.

(3) Petitioner has complied with the notification requirements pursuant to paragraph (2) of subdivision (f), Petitioner has provided Payee with a disclosure form that complies with Section 10136, and the transfer agreement complies with Sections 10136 and 10138.

(4) The transfer does not contravene any applicable statute or the order of any court or other government authority.

(5) Payee understands the terms of the transfer agreement, including the terms set forth in the disclosure statement required by Section 10136.

(6) Payee understands and does not wish to exercise Payee’s right to cancel the transfer agreement.

The Petition for Approval for Transfer of Payment Rights is GRANTED. Petitioner shall provide a formal order for the Court’s signature pursuant to California Rules of Court, rule 3.1312.
