Tentative Ruling

The Motion is DROPPED for defective service. Plaintiff Jaime Lester-Watts (“Plaintiff”) filed the instant motion for leave to amend his complaint, but the proof of service filed states that service of the motion was made by Plaintiff himself. As a party to the action, Plaintiff cannot serve his own papers to Defendant. As a result, notice was defective. Defective notice deprives the Court of jurisdiction to act. (Lee v. Placer Title Co. (1994) 28 Cal. App. 4th 503, 509, 511.) The minute order is effective immediately. No formal order pursuant to CRC Rule 3.1312 or further notice is required.
