RELIEF REQUESTED Attorney Arvin Artonian, counsel of record for plaintiff Maria Vasquez, seeks to be relieved as counsel for that party. Counsel has filed the required forms, served Ms. Vasquez by mail, and served defense counsel by email.
According to counsel's declaration, there has been a breakdown in the attorney-client relationship because counsel's office cannot communicate with or reach Ms. Vasquez. From May 19, 2026 through June 16, 2026, counsel has attempted to reach Ms. Vasquez 17 times through text messages, voicemails, and emails, concerning her deposition on June 19, 2026. But Ms. Vasquez did not respond. On June 16, 2026, counsel informed Ms. Vasquez via text of his intent to file the instant motion if she did not respond, but she never responded. Thus, counsel cannot properly represent Ms. Vasquez in this matter.
Because this motion was filed on June 17, 2026, it is unclear whether Ms. Vasquez appeared at the June 19, 2026, deposition. Regardless, counsel has demonstrated a breakdown in attorney-client communications. Absent a showing of resulting prejudice, an attorney's request for withdrawal should be granted. (People v. Prince¿ (1968) 268 Cal.App.2d 398, 406.)¿
Because there is no showing of prejudice and counsel has complied with the requirements in California Rules of Court, rule 3.1362(c)-(e), the court grants the motion.
