ORDER TO SHOW CAUSE AS TO JOHN YEE AND LILY YEE Receiver requested an issuance of the Order to Show Cause requiring the Yees to turn over all "cash proceeds" derived from the real property commonly known as 25 and 33 Drumm Street, San Francisco, California, 94111. The Court issued the OSC and Yees filed a response.
In accordance with the Order Appointing a Receiver dated July 29, 2024 and CC 2938, Epic Properties LLC (and Yees) were to turn over any security deposits, prepaid rent, other rental or lease payments, and funds in property management bank accounts," turn over "all . . . books, documents, and records relating to the property," and refrain from "diverting or using any of the rents;" and the Receiver was to collect and receive all rents, issues, and profits that have accrued but remain unpaid and uncollected by the assignor or its agent or for the assignor's benefit on that date, and all rents, issues, and profits that accrue on or after the date. The operative date for the above is July 29, 2024, under both CC 2938 and The Order Appointing Receiver.
Since there is no indication that Yees have failed to turn over any case proceeds since July 29, 2024, the Order to Show Cause is discharged. =(501/SKF)
