Matter on calendar for Wednesday, August 19, 2026, Line 2, PETITIONER JOSEPH ADAMS' Motion On Petition To Confirm Contratual Arbitration Award.

Petitioner Joseph B. Adams' motion to confirm the contractual arbitration award is GRANTED.

"A petition to confirm an award shall be served and filed not later than four years after the date of service of a signed copy of the award on the petitioner. A petition to vacate an award or to correct an award shall be served and filed not later than 100 days after the date of the service of a signed copy of the award on the petitioner." (Code Civ. Proc., section 1288.)

"A response requesting that an award be vacated or that an award be corrected shall be served and filed not later than 100 days after the date of service of a signed copy of the award." (Code Civ. Proc., section 1288.2.)

If a petition to confirm is duly served and filed, "the court shall confirm the award as made," unless the award is corrected or vacated, or the proceeding is dismissed. (Code Civ. Proc., section 1286.)

The record demonstrates Petitioners duly served and filed their petition. The court confirms the arbitration award. There is no basis to vacate or correct the award and the time to do so has passed per section 1288.

Respondent's request that the judgment be stayed, etc. are not properly before the court on this motion to confirm.

Petitioner is ordered to prepare a proposed "in conformity" with the award. (Code Civ. Proc., section 1287.4.) Petitioner is ordered, as well, to prepare a proposed order which repeats the above text verbatim and email it to contestdept302tr@sftc.org prior to the time set for hearing.

The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
