Ruling
Matter on the LAW AND MOTION / DISCOVERY Calendar for Wednesday, AUG-19-2026. LINE 2. 1-PLAINTIFF C. L.'s, BY AND THROUGH HIS GUARDIAN AD LITEM, AIMEE LEIFER Motion To Compel The Deposition Of Mobility Holding'S Employees, Hon, Hse, Lyn, Caplan And Its Pmq Regarding Product Specifications.
Plaintiff C.L.'s motion to compel the depositions of four Mobility Holdings, Ltd. Employees and the person most qualified from Mobility concerning product specifications is denied. Code of Civil Procedure, section 2024.020, subdivision (b), sets a discovery motion cutoff 15 days before trial. Trial in this case is set for August 24, 2026, and C.L. initially set this motion on August 18, only six days before trial. The court has the discretion to permit a late motion pursuant to Code of Civil Procedure, section 2024.050, but declines to do so here. C.L. does not show diligence. This case has been pending since May of 2024. C.L. first sought to depose a Mobility witness on or about May 28, 2026. (San Juan Decl., para. 6.)
