Ruling

2025CUPP055353: STEVEN R VAN HOOK vs CHANNEL ISLANDS HOA, et al. 05/18/2026 in Department 42 Motion for leave to file Second Amended Complaint

Tentative Ruling: Plaintiff Steven R. Van Hook’s motion for leave to file an amended complaint is DENIED without prejudice.

Plaintiff filed a motion for leave to file a second amended complaint on April 16, 2026. On April 28, all defendants filed demurrers and motions to strike the original complaint, presumably because the statutory period to respond to the complaint would have expired before the Court could rule on the motion for leave to file an amended complaint.

The proposed second amended complaint only minimally addresses some of the deficiencies identified in the demurrers and motions to strike. As such, for purposes of judicial efficiency, the Court finds that resources would be best conserved by ruling on the demurrers and motions to strike before ruling on any motion for leave to file an amended complaint.

Plaintiff’s motion is denied without prejudice. Defendant Kohan to give notice.
