Tentative Ruling

Plaintiff Citibank, N.A.’s (“Plaintiff”) motion to vacate dismissal and enter judgment under terms of stipulated settlement (Code Civ. Proc. § 664.6) is UNOPPOSED and is GRANTED.

Plaintiff’s request for judicial notice is granted.

On or about November 12, 2025, Plaintiff and Defendant Walter Bell (“Defendant”) entered into a stipulation (“Stipulation”) wherein Defendant agreed to pay a principal amount of $5,227.85 (“Judgment Amount”) plus “court costs pursuant to a memorandum of costs (which will be limited to Plaintiff’s fee for filing the complaint; Plaintiff’s fee for service of process; fees (including any reporter fee that the court may require at the time a motion or application is filed) for any motion, application, and/or order that has been granted, including the motion or application to enforce this Agreement and any order fee required to file the attached proposed order; and Defendant's first appearance fee if Plaintiff advances that fee in order to file this Agreement); less credit for payments made in good funds before the time of default.” (Request for Judicial Notice, Ex. Defendant agreed to pay $579.85 on or before November 19, 2025, followed by a minimum of $581.00 on or before the 19th day of each and every month commencing in December 19, 2025, until the Defendant has paid the Judgment Amount. The parties also agreed that the Court would retain jurisdiction under Code of Civil Procedure section 664.6. (Ibid.)

Plaintiff filed a request for dismissal on December 23, 2025. Defendant has paid a total of $1,300.85. (Declaration of Brian Langedyk, ¶ 6.) The last payment was received on January 23, 2026. (Id., ¶ 4.)

Plaintiff now seeks to vacate the dismissal and enter judgment in the amount of $4,530.61 which represents:

· Judgment Amount: $5,227.85 · Court Costs: 603.61 · Less Credits: -$1,300.85

The dismissal entered on December 23, 2025 is VACATED. The Court will sign the proposed order and judgment submitted.

Although remote participation is not required, the Court will presume all parties are appearing remotely for non-evidentiary civil hearings.

Parties requesting services of a court reporter will need to arrange for private court reporter services at their own expense, pursuant to Government code §68086 and California Rules of Court, Rule 2.956. Parties may contact Court- Approved Official Reporters Pro Tempore by utilizing the list of Court Approved Official Reporters Pro Tempore available at https://saccourt.ca.gov/home/showpublisheddocument/227/639084034465370000.

A Stipulation and Appointment of Official Reporter Pro Tempore (CV/E-206) is required to be signed by each party, the private court reporter, and the Judge prior to the hearing, if not using a reporter from the Court’s Approved Official Reporter Pro Tempore list.

Once the form is signed it must be filed with the clerk. If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away. Once approved, the clerk will forward the form to the Court Reporter’s Office and an official reporter will be provided.
