Procedural History 19 1) Petitioner Jason Conn (Father) and Respondent Darla Sharp (Mother) have one minor child, 20 Silver (DOB: 11/22/2016, age 9). Mother is represented by attorney Adam Wilson. 21 2) On 10/13/2025, Father filed a Request for Order seeking custody and visitation orders and 22 guideline child support. Father also checked the box to request attorney’s fees and costs and 23 stated that he “reserves the right to request attorney’s fees and costs if legal representation 24 becomes necessary.” 25 3) On 10/13/2025, Father filed a Financial Statement wherein he states he had been working as a bus 26 driver since 1/14/2025.

The paystubs attached to Father’s Financial Statement show that he 27 earned $15,906.06 in year-to-date income as of 9/28/2025, which averages out to $1,871 in gross 28 per month. 29

1 4) On 12/26/2025, Mother filed a Responsive Declaration outlining her requested custody and 2 visitation orders. Mother also asked the Court to deny Father’s request for child support and 3 asked the Court to order “each party to support the minor child financially when in each party’s 4 respective care, as the child’s needs are adequately met by this arrangement.” Mother also states 5 she has “covered the lion’s share of our daughter’s expenses her entire life.” Mother further 6 states, “Father’s Income and Expense Declaration does not show income he receives from the 7 sale of his art, which is an all cash / Venmo business.” 8 5) On 12/26/2025, Mother filed an Income and Expense Declaration.

Mother states she is 44 years 9 old and works 40 hours per week as a UX Manager for Google. Mother states she has worked for 10 Google since 2016. Mother states she earns on average $18,600 per month in gross. The paystubs 11 attached to Mother’s Income and Expense Declaration show that she earns variable compensation 12 above her regular pay, including: $57,000 in annual bonus and $285,845 in Google Stock Units as 13 of 12/14/2025. Mother states that she has $240,000 in cash, $9,000 in easily saleable investments, 14 and $119,000 in real property.

Mother states that her monthly expenses total $12,234, which 15 includes $3,660 per month for education. Mother states that she pays $1,391 per month for 16 mortgage payments and $4,500 per month for “rent for SF apartment.” 17 6) On 12/31/2025, a Child Custody and Visitation Stipulation and Order was filed which provides 18 that the parties will share joint legal custody of Silver and that Father will have one weekend per 19 month from Friday to Sunday (or to Monday if Monday is a holiday), with exchanges at the 20 Dublin Bart station on Fridays and the Sunday exchange at a Chevron station in Tracy, CA.

The 21 Stipulation also provides that Father will have one week with Silver in June, July, and August, 22 one week during Winter Break, and one week during Spring Break. 23 7) On 3/30/2026 and 4/6/2026, Father filed declarations containing many statements regarding 24 custody and timeshare. Father also states, “Mother’s reference to art sales may relate to a one year 25 period years ago when we briefly operated a gallery. Since then, I have maintained regular 26 employment, and any art sales are occasional and not a primary source of income.

In the past 27 year, such sales totaled less than $1,200.” 28

1 8) At the prior 4/14/2026 hearing, the Court ordered the parties to return to mediation, ordered 2 Father to file and serve an updated Income and Expense Declaration, and continued the matter to 3 6/11/2026. 4 9) On 6/2/2026 Father filed an Update Declaration which contained information relating to custody 5 and timeshare. In addition, Father asked the Court to order Mother to pay for 100% of hotel 6 lodging costs and gas (for up to $350 per night for a maximum of two nights) for optional 7 monthly visits to the San Francisco Bay Area for up to four times per year. 8 10) At the prior 6/11/2026 hearing, because the parties did not stipulate to a Judge Pro Tem making 9 orders that day, future hearing dates were set for 7/7/2026 (regarding custody and visitation) and 10 to 8/18/2026 (on Father’s financial requests). 11 11) At the 7/7/2026 hearing, the Court made the following orders (among other orders made): 12 12) For Summer 2026, Father shall have parenting time from 7/26/26 until 8/05/26 and again from 13 8/16/26 until 8/23/26.

For 8/16/26 to 8/23/26, Father shall ensure the child goes to bed 14 sufficiently early to prep for her return to school during the following week. 15 13) For Summer 2027, the parties shall work on a two-week-on-two-week off schedule, with the 1st 16 two weeks going to Father. For the final week before school starts, the parties shall split the week, 17 with Father having the first half of the week and Mother having the second half of the week. 18 14) For Ski Week, the parties shall split the week with one party having Sunday to Wednesday and 19 the other party having Wednesday to Sunday. 20 15) Father shall have parenting time with the child every Thanksgiving Break from Sunday to 21 Sunday, with the understanding that sometimes the child’s birthday will fall during this time and 22 sometimes will not. 23 16) The Court maintains the current orders for Spring Break and Winter Break. 24 17) Father’s request for four additional annual visits to be paid by Mother shall be addressed on 25 8/18/26 at 9:00 a.m. in Dept. 404 when the financial hearing is already set. 26 18) On 8/10/2026, Father filed an Income and Expense Declaration.

Father states he is 49 years old 27 and has been employed as a music teacher for Tuolumne County since 3/9/2026. Father states he 28 works 30 hours per week and is paid $2,013 per month in salary and wages, and an average of 29 $680 per month in commissions or bonuses. Father states, “I do not receive a monthly bonus three

1 months out of the year. Therefore my annual income is stipend of $25,000 that is distributed 12 2 months. Plus bonus’ 9 months of the year that average less than $700.” Father lists no other 3 sources of income. Father states he has $1,327 in cash savings. Father reports that his monthly 4 expenses total $1,765. Father states $900 of this is “paid by others”. Father states he lives with his 5 wife who earns $3,892 per month and pays some of the household expenses. 6 19) Mother has not filed an Income and Expense Declaration in this matter since December 2025. 7 20) Neither party has filed a Statement of Support Calculation to date. 8 B.

Findings and Order 9 1) Additional Visitation for Father 10 a. Effective 9/1/2026, the Court hereby grants Father’s request to have additional visits with 11 Silver for up to two consecutive nights per visit in the San Francisco Bay Area up to four 12 times per year, in addition to the timeshare previously ordered. 13 b. The parties shall share the costs for lodging and gas 86% (Mother) / 14% (Father) as set forth 14 below. Mother’s share of these expenses shall not exceed $350 per visit. 15 2) Base Guideline Child Support 16 a.

For the period 1/1/2026 (the approximate date upon which the Child Custody and Visitation 17 Stipulation and Order was filed) through 2/28/2026, in accordance with the first XSpouse 18 calculation attached hereto and incorporated herein, Mother shall pay Father base guideline 19 child support of $175 per month. 20 b. For the period 3/9/2026 (the date Father began his new job) – 8/30/2026, in accordance with 21 the second XSpouse calculation attached hereto and incorporated herein, Mother shall pay 22 Father base guideline child support of $142 per month. 23 c.

Effective 9/1/2026 (approximately when Silver’s new school year begins and the new 24 summer schedule will go into effect), in accordance with the second XSpouse calculation 25 attached hereto and incorporated herein, Mother shall pay Father base guideline child support 26 of $371 per month. Base child support shall be paid by the 5th of each month. 27 3) Base Child Support Arrears 28 a. Based on the foregoing the Court finds Mother owes to Father $350 in base child support 29 arrears for the period 1/1/2026 – 2/28/2026, $45 for 3/1/2026 - 3/8/2026, $105 for 3/9/2026 –

1 3/31/2026, and $710 for 4/1/2026 - 8/30/2026, for total base child support arrears due and 2 owing of $1,210. Mother shall pay this amount to Father no later than Friday, 8/21/2026 at 3 5:00 PM. 4 4) Smith / Ostler Child Support 5 a. For ease of calculation, the Court will make the effective dates for the Smith / Ostler child 6 support orders and child support add-on orders effective 9/1/2026. 7 b. Effective 9/1/2026, the parties shall pay Smith/Ostler child support on income earned above 8 their respective base salaries, in accordance with the Bonus Reports attached to the third 9 XSpouse report.

Income subject to Smith/Ostler child support shall include, but is not limited 10 to, bonus income, proceeds from Father’s artwork, and the gross value of Mother’s GSUs that 11 vest on or after 9/1/2026 (calculated as the number of GSUs vested multiplied by the fair 12 market value per share on the vesting date). The parties shall conduct quarterly true-ups to 13 determine the amount of Smith/Ostler child support owed. The parties shall exchange 14 documentation showing all income earned during the immediately preceding three-month 15 period no later than January 15, April 15, July 15, and October 15 of each year.

The parties 16 shall thereafter meet and confer regarding the amount of Smith/Ostler child support owed, 17 which shall be paid no later than January 31, April 30, July 31, and October 31, respectively. 18 The first true-up shall occur in January 2027 and shall encompass income earned from 19 9/1/2026 through 12/31/2026. The parties shall exchange documentation for the first true-up 20 no later than 1/15/2027. 21 5) Child Support Add-Ons 22 a. Effective 9/1/2026, the parties shall share 86% (Mother) / 14% (Father) the following child 23 support add-ons: 24 i.

The reasonable uninsured health care costs for Silver as provided in Family Code 25 section 4063. 26 ii. Childcare costs, if those expenses are actually incurred, related to employment or to 27 reasonably necessary education or training for employment skills, as described in 28 Family Code section 4063. 29

1 iii. Lodging and gas for Father to visit Silver in the San Francisco Bay Area up to four 2 times per year as set forth above. Mother’s share of these expenses shall not exceed 3 $350 per visit. 4 b. The procedure for requesting and paying reimbursements for uninsured healthcare costs shall 5 be as set forth in Judicial Council Form FL-192. 6 c. The procedure for requesting and paying reimbursements for qualifying childcare costs and 7 qualifying lodging / gas expenses shall be as follows. When a party (e.g.

Party A) pays for a 8 qualifying expense, within 30 days of paying the expense, Party A shall present to Party B: 9 (a) an itemized statement of charges, (b) proof of payment, and (c) the amount due and owing 10 from Party B. Within 10 days of receiving this information, Party B shall submit a payment to 11 Party A for Party B’s share of the expense. 12 6) XSpouse Inputs 13 a. The inputs used in the XSpouse calculations are based on the following findings: 14 b. Between January 2026 and August 2026, Father had a timeshare of one weekend per month 15 during the school year, 31 days during the summer, one week of Spring Break, and one week 16 of Winter Break.

The Court finds this amounts to a 16% timeshare. 17 c. Effective September 2026, Father will have a timeshare of one weekend per month, 6.5 18 weeks during the summer, one week of Spring Break, Thanksgiving week, one week of 19 Winter Break, half of Ski Week, and an additional 8 nights per year for visitation in San 20 Francisco. The Court finds this amounts to a 22% timeshare. 21 d. Between January 2026 through 3/8/2026, Father was earning on average $1,871 per month. 22 e. Effective 3/9/2026, Father states he is earning $25,000 per year in base salary.

This averages 23 out to $2,083 per month. 24 f. Mother earns $18,500 in gross per month in base salary. 25 g. Based on the paystubs attached to Mother’s Income and Expense Declaration, the Court finds 26 that Mother contributes on average $1,958 per month to her 401(k) and $224 is deducted 27 from her pay per month for vision, dental, and health insurance. 28 7) Mother’s attorney shall prepare the Findings and Order After Hearing, which shall include as 29 attachments the mandatory FL-342 form, the XSpouse calculations, and the bonus tables.

1 8) Preparation of Order: If you are directed by the court to prepare the order after hearing – within 10

2 calendar days of the hearing you must either: (a) Serve the proposed order to the other party/counsel 3 for approval, and follow the procedures set forth in CA Rules of Court, Rule 5.125(c), or (b) If the 4 other party did not appear or the matter was uncontested, submit the proposed order after hearing 5 directly to the court. Failure to submit the order after hearing within 10 days may allow the other 6 party to prepare a proposed order and submit it to the court in accordance with CA Rules of Court, 7 Rule 5.125(d). 8
