LUNA) 11) 12 REQUEST FOR ORDER OF CHILD CUSTODY, VISITATION (PARENTING TIME) 13 TENTATIVE RULING 14 Having read and considered the pleadings, declarations, and other evidence submitted in this matter, the 15 Court makes the following findings and orders: 16 A. Procedural History 17 1) The parties to the proceeding are Petitioner Daniella Perez (Mother) and Respondent John 18 Charles Dixon (Father).
They share one minor child: John Charles Dixon Jr. (DOB: 09/24/15). 19 2) On May 13, 2026, Mother filed a Request for Order seeking child custody and visitation orders. 20 In particular, Mother is seeking orders for sole legal and sole physical custody and professionally 21 supervised visitation for Father. 22 3) On May 27, 2026, Father filed a Responsive Declaration in which he asks for joint legal custody 23 and sole physical custody to Mother. In addition, he asks that his parenting time be every second 24 and fourth weekend from Friday after school until Sunday at 5:00 p.m.
He is also requesting the 25 implementation of a Holiday schedule. 26 4) On June 15, 2026, both parties appeared at the “Readiness” hearing and the parties were referred 27 to FCS Mediation to occur on July 30, 2026 and set a return hearing for August 18, 2026. 28 5) On July 15, 2026, Father filed a supplemental declaration, which has been read and considered by 29 the Court.
1 6) On July 16, 2026, Father filed another supplemental declaration, which contained an attached 2 exhibit. 3 B. Findings and Order 4 1) This Court has jurisdiction to make child custody orders in this case under the Uniform Child 5 Custody Jurisdiction and Enforcement Act. A violation of this order may subject the party in 6 violation to civil or criminal penalties, or both. The country of habitual residence of the minor 7 child(ren) is the United States. 8 2) Mother shall have sole legal and sole physical custody of the minor child. 9 3) Father shall have parenting time with the minor child every other weekend, commencing August 10 22, 2026.
Father’s parenting time shall be as follows: 11 a. Saturdays – 10:00 a.m. – 4:00 p.m. 12 b. Sundays – 10:00 a.m. – 4:00 p.m. 13 4) In addition, Father may have parenting time with the minor child every Wednesday from after 14 school until 7:00 p.m. 15 5) The Court has concerns about allegations of Father’s alcohol abuse/addiction. The Court would 16 urge Father to obtain help for his problem with alcohol. Should Father desire to change the 17 custody and visitation orders, the Court will consider any and all steps Father has taken in this 18 regard.
If Father chooses to do nothing, then the Court probably will not entertain any request he 19 may have for additional time. 20 6) The Court will set a review hearing on November 24, 2026, to review child custody and 21 visitation. 22 7) The Court will prepare the Findings and Order After Hearing. 23
