Plaintiff's Motion to Vacate Unauthorized Peremptory Challenge is DENIED. Moving party's oversized brief is stricken.
The Court notes that the relief requested in this motion ("restoring the matter to the department of Judge Haines" Points and Authorities page 33) does not appear to serve any purpose given the procedural posture of this case. This action has been reduced to judgment, and the appeal has been dismissed. There are no further motions on the merits of the action that may be heard at this time. Vacatur of the challenge would not have a retroactive effect.
Additionally, this motion is being heard in the department to which it has been assigned, Department 501. December 8, 2025 and February 10, 2026 hearings were also held in department 501. This action has never been singly assigned to the Honorable Charles F. Haines. Judge Haines is one of the 3 judges regularly assigned to laws and motion departments; and any other judge, per the order of the presiding judge, may be assigned to the department, case, or individual motion at any time.=(501/SKF)
