Plaintiff's motion to enforce settlement agreement and release is continued for hearing to September 18, 2026, with supplemental briefing ordered.
Plaintiff's opening brief recites delay in making arrangements to surrender the car; under the settlement agreement; payment is required five business days after surrender. Plaintiff's reply states that the car was surrendered on August 5, 2026. As of the time of Plaintiff's reply brief on August 11, 2026, no payment had been made, but payment was not due until August 12 under the settlement agreement.
By September 4, 2026, Plaintiff shall file a supplemental brief stating what, if any, terms of the settlement agreement remain outstanding. Defendant may file a supplemental brief by September 11, 2026. If the motion is resolved Plaintiff may take it off calendar.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 301 remotely or in person. Remote hearings will be conducted by videoconference using Zoom.
