PLAINTIFFS LI KUANG, TOMMY CHAN'S Motion To Compel Discovery. Plaintiffs Li Chang Kuang and Tommy Chan seek a deemed-admitted order as to their first set of Requests for Admission to defendant Kenny Wong. They further seek an order compelling objection-free, verified responses to their form and special interrogatories, and an order for Wong to pay sanctions. The motion is granted in part and continued for hearing with direction to the parties.

The court finds that Wong was properly served with the discovery. The court rejected a prior motion to compel because email service was not proper service on a pro per defendant who had not agreed to accept service in that manner. Plaintiffs provide proofs of service showing that they mailed the discovery on June 10, 2026, to the address that Wong uses on his pleadings.

Wong's opposition states that he will provide responses to the requests for admission before the hearing date. He provides a declaration stating that he did not receive the discovery in June. (Wong Decl., para. 3.) He asks for relief from any waiver of objections.

The court continues the motion for hearing to September 29, 2026 to give Wong an opportunity to respond to the discovery so that it can determine whether he has substantially complied with his discovery obligations, such that relief from waiver may be proper. (Code Civ. Proc., sec. 2030.310, subd. (a); id., 2033.280, subd. (a).)

The court orders Wong to respond to the requests for admission, special interrogatories, and form interrogatories by September 8, 2026. Wong shall submit a supplemental brief by September 15, 2026 stating why he believes his responses substantially comply with the relevant discovery statutes; he shall include a declaration attaching his discovery responses. Plaintiffs may submit a supplemental brief on reply by September 22, 2026. The court defers consideration of Plaintiffs' sanctions request to the September 29 continued hearing date.

If no party contests the tentative ruling, it will be adopted verbatim in a minute order.

The court no longer provides a court reporter in the Law & Motion or Discovery Department. Parties may retain their own reporter, who may appear in the courtroom or remotely.
